Court Decisions on the Validity of the Elections

Abstract:

Tato diplomová práce obsahuje základní teoretický přehled problematiky voleb a volebního soudnictví, včetně historického vývoje volebního soudnictví ve světě i v českých zemích. Dále pak obsahuje popis současné úpravy voleb a volebního soudnictví včetně jejich ústavního rámce. Na tomto teoretickém a popisném podkladě je v práci čtenáři nabídnut rozbor volební judikatury z posledních dvaceti let českého volebního soudnictví, se zaměřením především na současné problémy volebního práva a volebního soudnictví, a to nakupování hlasů, sestěhovávání voličů a okruhu účastníků v řízení o neplatnosti voleb. V rámci celé práce jsou čtenáři nabídnuty ke zvážení i různé úvahy autora de lege ferenda o řešení existujících problémů.

Abstract:

The thesis includes the basic theoretical review of the elections and electoral jurisdiction law, with historical review of the electoral jurisdiction evolution in the world and also czech geographical area attached. The thesis then comprises of the description of the current electoral law and electoral jurisdiction law, with their respective constitutional basis. On this theoretical and descriptory fundament, the reader is offered an analysis of the electoral jurisdiction court decisions from the last twenty years of czechc electoral jurisdiction, with the main focus being the current problems of czech electoral law and electoral jurisdiction – the buying of votes, electorate migration into one settlement and the problems around the circle of participants in the elections validity procedure. In the whole thesis, the reader is also offered various ideas of the author on the possible solutions of the current existing problems.
