Personnel Security in Protection of Classified Information

Abstract:

Práce se zabývá problematikou personální bezpečnosti při ochraně utajovaných informací, a to jak z pohledu v současné době platné a účinné právní úpravy, tedy zákona č. 412/2005 Sb., o ochraně utajovaných informací a o bezpečnostní způsobilosti, tak také z hlediska jejího vývoje, tedy zákonů č. 102/1971 Sb., o ochraně státního tajemství a č. 148/1998 Sb., o ochraně utajovaných skutečností. Za pomoci judikátů jsou blíže rozebírány trestné činy spojené s ochranou utajovaných informací a také bezpečnostní rizika definovaná v zákoně. Prostřednictvím platné právní úpravy a dále judikátů soudů jsou potvrzovány dvě hypotézy stanovené v úvodu diplomové práce týkající se spravedlivého procesu a existence bezpečnostního rizika. Závěrečná kapitola upozorňuje na některé nedostatky zákona z pohledu autora a věnuje se úvahám de lege ferenda.

Abstract:

The thesis deals with the topic of personnel security when protecting classified information, both from the perspective of the valid legislation currently in effect, i.e. the Czech law no. 412/2005 Sb. about the protection of classified information and about security capacity, as well as from the perspective of the legislation development, i.e. the laws no. 102/1971 Sb. about the protection of state secrecy and no. 148/1998 Sb. about the protection of classified facts. With the aid of judicates, crimes committed in relation to the protection of classified information, and security risks defined by the law are further discussed. Via the valid legislation and subsequently court judicates, two hypotheses set out in the introductory part of the diploma thesis related to the fair process and to the existence of a security risk are being confirmed. The final chapter points out certain shortcomings of the law from the author's point of view and is also concerned with de lege ferenda deliberations.
