The role of security clearance in legislative and executive branches

Abstract:

Cílem této diplomové práce je zjistit význam bezpečnostní prověrky v oblasti zákonodárné a výkonné moci v České republice. Autor zhodnotil stávající právní úpravu a pomocí empirického výzkumu navrhnul změny v zákoně č. 412/2005 Sb., o ochraně utajovaných informací a bezpečnostní způsobilosti a zákoně č. 114/1993 Sb., o Kanceláři prezidenta republiky, které by vedly ke zdokonalení přístupu k utajovaným informacím v rámci Parlamentu ČR, ministerstev a Kanceláře prezidenta republiky.

Abstract:

The aim of this diploma work is to establish the importance of security clearance in legislative and executive branches in the Czech Republic. The author examined the contemporary form of security clearance and with the help of empirical research proposed changes concerning the act No 412/2005 Coll. of September, 21, 2005, on the Protection of classified information and security eligibility, and the act No 114/1993 Coll. of March 24, 1993, on the Office of the President of the Republic, which would lead to improvement of the access to classified information in terms of the Parliament of the Czech Pepublic, ministeries and the Office of the President of the Republic.
