The Schengen area and its principles

Abstract:

Diplomová práce se zabývá problematikou Schengenského prostoru a jeho principy. Pozornost je věnována zejména vzniku Schengenského prostoru, legislativě, vízové politice a migraci, policejní a justiční spolupráci, vstupu České republiky do tohoto prostoru. Cílem práce je popis právních úprav a jejich případných změn a popis vývoje legislativy. Dále pak obecné zmapování historie vzniku Schengenského prostoru a postupného přistupování jednotlivých států k tomuto prostoru. Práce podrobně objasňuje na základě zpracování literárních pramenů a právních norem druhy víz a jejich platnost, druhy pobytů. Samostatná část je věnována problematice migrace lidí a azylu. Diplomová práce rovněž specifikuje policejní a justiční spolupráci. Popisuje systémy, díky kterým jsou předávány důležité informace a je kontrolováno vydávání víz. Závěrečná část je věnována vstupu České republiky do Schengenského prostoru a částečně zhodnocuje změny, které naší zemi přinesl vstup do tohoto prostoru.

Abstract:

The thesis deals with the issue of the Schengen area and its principles. The main focus is on the creation of the Schengen area, legislation, visa politics and migration, police and justice cooperation, entering of the Czech republic into the Schengen area. The aim of the thesis is the description of legal regulations and their eventual changes and the description of legislation development. Farther the common charting of the history of the creation of the Schengen area and step-by-step accessing of individual states into the area. The thesis clarifies in detail the kinds of visas and their validity, the kinds of stays on the basis of elaboration of literary springs and rules of law. The individual part is dedicated to the issue of illegal migration. The thesis specifies police and justice cooperation as well. It describes the systems thanks to them the important information is forwarded and the visa issuing is controlled. The conclusion part is dedicated to the entering of the Czech republic into the Schengen area and it reviews partially the changes which happened after the entering of the Czech republic into the Schengen area.
