EU Border Management and the Role of FRONTEX

Abstract:

Disertační práce „Ochrana hranic EU a role agentury FRONTEX v ní“ se zabývá rolí, kterou hraje Agentura pro řízení operativní spolupráce na vnějších hranicích členských států, známá spíše pod zkratkou FRONTEX, v ochraně vnějších hranic EU. Snahou práce je analyzovat reálný dopad, který má fungování mladé agentury, jakou FRONTEX je, v ochraně hranic proti nelegální migraci. S ohledem na senzitivní povahu hranic, které bývají spojovány se státní suverenitou, byla autorem stanovena následující hypotéza: „Přes vznik institucionalizované spolupráce, kterou FRONTEX představuje, si oblast ochrany hranic zachovává výraznou intergovernmentální logiku, což souvisí s neochotou států vzdát se autonomie a suverenity v této politicky citlivé oblasti“. Pro účely výzkumu bylo vytvořeno integrační kontinuum na ose intergovernmentalní spolupráce/supranacionální uspořádání, v rámci kterého byly zkoumány jednotlivé aktivity agentury. Práce pak obsahuje dvě výzkumné otázky, přičemž první se soustředí na to, jaká je v rámci ochrany hranic EU role FRONTEXu ve vztahu k členským státům. Druhá se pak soustředí na reálný vliv supranacionálních institucí na formování politiky v oblasti ochrany hranic, především ve smyslu snah o posílení pozice agentury FRONTEX. Výsledkem zkoumání byla identifikace sílící přítomnosti FRONTEXu v ochraně vnějších hranic, projevující se nárůstem jím koordinovaných aktivit. Na druhou stranu se prokázalo, že agentura je do značné míry závislá na ochotě členských států spolupracovat. Ta se odvíjí od zájmů jednotlivých států a lze tvrdit, že FRONTEXu se doposud nepodařilo vytvořit atmosféru solidarity v oblasti ochrany hranic. Práce též prokázala konzistentní snahu Evropské komise a Evropského parlamentu o posílení evropské úrovně ochrany hranic. Nicméně text na několika případech ilustruje střet těchto snah s rezistencí členských států postoupit větší množství kompetencí na komunitární úroveň, jejichž výsledkem je fakt, že státy stále zůstávají hlavními aktéry ochrany hranic.

Abstract:

The aim of the dissertation thesis “EU Border Management and the Role of FRONTEX” is to examine the role of the European Agency for the Management of the Operative Cooperation at the External Borders of the European Union, generally known as FRONTEX, in the area of border management. The author seeks to analyze the real role that a young agency like FRONTEX plays in the protection of the borders against illegal migration. With regard to the sensitive nature of borders, that are often perceived as one of the key features of the state’s sovereignty, the author has developed following hypothesis „Despite the emergence of institutionalized cooperation, which is confirmed by the establishment of FRONTEX, the area of border protection retains its intergovernmental logic that is connected to the reluctance of the Member States to transfer their autonomy and sovereignty in this sensitive area”. For the purpose of the research an integration continuum was created where the poles are intergovernmental cooperation and strong supranational setup. The activities of the Agency are examined within this continuum. The author has consequently set up two main research questions. The first focuses on the relation between FRONTEX and the Member States that still hold the responsibility for the protection of the external borders. The second question concentrates on the relation between the Member States and European institutions and asks: “What is the real impact of supranational actors on the formation of the border-management policy?”. The research has shown that FRONTEX has emerged as a very present player in the field of the border management and its activities have grown up rapidly . On the other hand it has also shown that activities of FRONTEX considerably depend on the good will of the Member States to cooperate, which reflects the interests of the Member States. So far, FRONTEX has not managed to create genuine aura of solidarity in the external borders management. The text has also displayed continuous efforts of the European Commission and the European Parliament to strengthen the European level of border management. However these efforts have been met with resistence from various Member States which lead to the fact that the Member States still remain key players in the border management.
