Abstract:

Diplomová práce se zabývá institutem kolektivní dohody ve státní službě, přičemž se nesoustředí pouze na jeho právní vymezení a popis jeho účelu, ale hodnotí ho rovněž po obsahové stránce za současné konfrontace s institutem kolektivní smlouvy. Diplomová práce ověřuje tezi, že co do faktického obsahu v kolektivní dohodě obsažených práv osob ve služebním poměru kolektivní dohoda v podstatné míře „kopíruje“ obsah práv obsažených v kolektivní smlouvě. Tato komparace má za cíl potvrdit, nebo vyvrátit, obecný názor ohledně výhodnějších podmínek pro osoby ve služebním poměru oproti osobám v pracovním poměru. Práce pojednává rovněž o problematice v praxi se objevujícího přejímání některých soukromoprávních institutů skrze institut kolektivní dohody do oblasti veřejného práva a navrhuje možná řešení vzájemných střetů. V případě zjištěných nedostatků si tato diplomová práce rovněž klade za cíl navrhnout ve vztahu k institutu kolektivní dohody možná řešení de lege ferenda.

Abstract:

The diploma thesis deals with the institute of collective agreement in civil service, while not only focusing on its legal definition and its purpose, but also evaluates this civil-law institute in terms of its content and confronts it with its private-law equivalent. The diploma thesis verifies the theory that in terms of practical content regarding the rights of persons in the service, this civil-law collective agreement substantially „copies“ the content of the rights contained in the private-law collective agreement. This comparison aims to confirm or disprove the general view of the more favorable terms and conditions for persons in civil service versus those in private employment. The thesis also discusses the issue of the practical takeover of some private-law institutes through the institute of civil-law collective agreement in the area of public law and suggests possible solutions to these conflicts. In case of identified shortcomings, the thesis aims to propose possible solutions de lege ferenda in relation to the civil-law collective agreement.
