Administrative Offences in the Light of the Supreme Administrative Court s Judicature

Abstract:

Touto mou bakalářskou prací se pokouším osvětlit a upozornit na složitou právní problematiku, především se zaměřením na řešení správních deliktů a následných rozhodnutí. Současně se snažím objasnit postavení nejvyššího správního soudu a Ústavního soudu ve zmíněné problematice. V prvé části mé práce se okrajově věnuji nastínění procesních otázek správního práva, a to od roku 1867 do současnosti. V druhé části se snažím osvětlit problematiku dvou významných legislativních opatření, a to správního řádu a vazeb a vztahů ke stavebnímu zákonu, kterým je v daném případě dáno postavení lex specialis ve vztahu k projednávání správních deliktů. Proto, prosím, aby moje práce byla chápána jako ucelený systém řešení správních deliktů ve vztahu ke stavebnímu zákonu, podpořený vybranou judikaturou Ústavního soudu ČR a Nejvyššího správního soudu. Závěr práce věnuji stále se rozvíjejícímu postavení Nejvyššího správního soudu, především jeho rozhodnutím, která tento již judikoval, včetně dopadů do rozhodování příslušných orgánů, řešících předmětnou problematiku.

Abstract:

In my bachelor thesis I intend to bring to attention and to cast some light on the complex law issues concerning in particular the treatment of administrative offenses as well as the subsequent verdicts. At the same time I try to clarify the role of the Supreme Administrative Court and of the Constitutional Court in this matter. In the first part of my work I superficially address the practical questions of administrative law from 1867 up to the present. In the other part of my work I intend to shed light on the problems associated with two legal measures, namely the administrative code and it links and relation to the building law. In the given case, the two legal measures are accorded the role of lex specialis in their relation to the investigation of administrative offenses. I therefore insist that my work be understood as a compacted system of administrative offense resolution in relation to the building law and supported by the selected case law of the Constitutional Court of the Czech Republic and of the Supreme Administrative Court. The concluding part of my thesis is dedicated to the continual development of the role of the Supreme Administrative Court, in particular to its verdicts which have been judcially established as well as to the impacts on the decision making of the authorities concerned.
