Illegal Migration of Persons to the European Union

Abstract:

Ve své práci se věnuji nelegální migraci do zemí EU přes státní hranice České republiky. Tisíce zájemců o přesídlení v současné době převýšil možnosti a ochotu cílových zemí je legálně přijmout bez možnosti omezení jejich vlastní ekonomiky a bezpečnostní stabilizace. Tuto nenaplněnou poptávku za cestou k lepšímu životu uspokojuje organizovaný zločin. Neboť právě nelegální migrace je úzce spjata s organizovaným zločinem, kterému přináší nemalé zisky. Ve své práci osvětluji čtenáři základní pojmy týkající se nelegální migrace a její důvody, vývoj a způsoby v posledních deseti letech. Důležitým mezníkem je zde prosinec roku 2007 kdy vstoupila Česká republika do schengenského prostoru. V práci jsou popisovány způsoby a formy nelegální migrace a práce převaděčských organizací před vstupem a po vstupu ČR do schengenského prostoru. Vstup České republiky do schengenského prostoru je pro sledování projevů nelegální migrace značně důležitý, neboť tímto vstupem Česká republika „ztrácí“ svoji přirozenou vnější hranici a dle zákona není nelegální překročení státní hranice tzv. „vnitřní“ trestným činem. Další téma, kterému se věnuji je komparace starého trestného zákona č. 140/1961 Sb. s ustanovením jež se zaobírá nelegální migrací přes státní hranici a nového trestního zákoníku č. 40/2009 Sb. s obdobným ustanovením. V této části uvádím, též, úskalí s nimiž se orgány činné v trestném řízení potýkají při objasňování této specifické trestné činnosti.

Abstract:

At present, developed countries of Western Europe have to deal with a highly dynamic global social phenomenon, which was, is and will be present as long as the mankind itself and its social and economic differences exist. This phenomenon is called illegal migration. In my thesis, I deal with illegal migration into the EU countries across the state border of the Czech Republic. The number of individuals interested in relocation currently exceeds the possibilities and willingness of the destination countries for accepting them legally without limiting their own economy and security. Organized crime meets this unfulfilled demand for a better way of life. Illegal migration is closely linked with organized crime to which it brings considerable profits. I explain the basic concepts concerning this criminal activity, the reasons for it and its development and manners in the last decade. An important milestone is December 2007 when the Czech Republic entered the Schengen area. The thesis describes the manners and forms of illegal migration and activities of organizations of human smugglers before and after the accession of the Czech Republic to the Shengen area. The accession of the Czech Republic to the Schengen area is very important for monitoring of illegal immigration for the Czech Republic has “lost” its natural outer frontier whereas illegal border crossing is not considered an “internal” criminal act cording to law. Comparison of the old Criminal Code No.140/1961 with the provision that deals with illegal migration across the border and new Criminal code no. 40/2009 with a similar provision is another topic which is dealt with in this thesis. I have also specified the difficulties encountered by law enforcing authorities when investigating this specific criminal activity.
