Law of the European community - Application of European Union Laws and Activities of The Court of Justice of European Communities

Abstract:

Evropská společenství jsou mezinárodními organizacemi. Jejich účelem je integrace a zajištění společného života na společném území při zajištění určitých kvalit této existence. Rozdíly členské základny Evropských společenství se projevují jak v samotné existenci, tak i charakterem a způsobem rozhodování Evropského soudního dvora. Zastoupení všech členských právních kultur je zajištěno výběrem soudců z jednotlivých zemí. Rozhodování Evropského soudního dvora nelze přirovnat k rozhodování klasických soudních orgánů zařazených do soudních soustav členských zemí. Řízení, ve kterých Evropský soudní dvůr rozhoduje, jsou obsahem činnosti různých soudů v členských zemích. Evropský soudní dvůr v sobě kumuluje funkce soudního systému jako celku. Judikatura Evropského soudního dvora je součástí komunitárního práva. Je nezbytné respektovat rozhodnutí Evropského soudního dvora a jeho právních názorů.

Abstract:

The European Communities are international organizations. Their purpose is to ensure integration and common life in the common areas, while ensuring the existence of certain qualities. Differences membership the European Communities are reflected in the very existence and the nature and method of decision the European Court of Justice. Member of legal representation of all cultures is ensured by the selection of judges from each country. The decision of the Court of Justice can not be compared to a conventional decision-making judicial authorities included in the judicial systems of member countries. Management, in which the European Court of Justice decides the content of the activities of the various courts in the Member States. The European Court of Justice itself accumulates in the judicial system functions as a whole. The case-law of the European Court of Justice is part of Community law. It is necessary to respect the decision of the European Court of Justice and its legal views.
