Execution Proceedings in Land Register: Socio-Economic Contexts

Abstract:

Cílem bakalářské práce s názvem "Exekuční řízení v katastru nemovitostí - socio-ekonomické souvislosti" je identifikace příčin ovlivňujících vývoj počtu zápisů exekučních příkazů o prodeji nemovitosti v Moravskoslezském kraji v období let 2015-2020 a jaké má vývoj počtu exekucí v Moravskoslezském kraji společensko-ekonomické důsledky. Bakalářská práce je rozdělena do tří kapitol. Předmětem první kapitoly jsou historické, institucionální a legislativní východiska s vysvětlením pojmů týkajících se exekučního řízení, které vychází z exekučního řádu a také vysvětlením pojmů týkajících se katastru nemovitostí. Ve druhé kapitole je pozornost věnována detailnějšímu popisu zápisů exekučních řízení, konkrétně exekučních příkazů o prodeji nemovitostí v katastru nemovitostí. Pozornost je rovněž zaměřena na popis jejich vývoje v Moravskoslezském kraji ve čtvrtletních údajích 2015-2020. Obsahem třetí kapitoly je praktická část bakalářské práce. Je provedena korelační analýza zápisů exekučních příkazů a vybraného socio-ekonomického ukazatele, kterým je obecná míra nezaměstnanosti. Dále jsou diskutovány možné příčiny klesajícího vývojového trendu počtu zápisů exekučních příkazů a možné socio-ekonomické souvislosti exekučních řízení v Moravskoslezském kraji.

Abstract:

The aim of the bachelor thesis named "Execution proceedings in Land register: socio-economic contexts" is to identify the causes affecting the development of the number of records of execution orders on real estates in the Moravian-Silesian region in the period 2015-2020 and what are socio-economical impacts of them in Moravian-Silesian Region. The bachelor thesis is divided into three chapters. The subject of the first chapter is the historical, institutional and legislative starting points with an explanation of the terms related to the execution procedure, which is based on the execution regulation and also with an explanation of the terms related to the real Land register. In the second chapter, aim is focused to a more detailed description of the records of execution proceedings, specifically execution orders on the sale of real estate in the real Land register. Attention is also focused on the description of their development in the Moravian-Silesian Region in the quarterly data from 2015 to 2020. The contents of the third chapter is the practical part of the bachelor thesis. A correlation analysis of the records of execution orders and a selected socio-economic indicator, which is the general unemployment rate, is performed there. Furthermore, possible causes of the declining development trend in the number of recordings of execution orders and possible socio-economic context of execution proceedings in the Moravian-Silesian Region are discussed.
