Analysis of chosen housing facility with insolvent status and its options of resolvement

Abstract:

Diplomová práce se zabývá analýzou úpadkového stavu vybraného ubytovacího zařízení a možnostmi jeho řešení. Cílem práce je nalezení příčin úpadku a navržení možných řešení, která by vedla k jeho odstranění. Práce je rozdělena na teoreticko-metodologickou, analytickou a návrhovou část. Teoreticko-metodologická část se zabývá historickým vývojem insolvenčního řízení, insolvenčním zákonem a definicí úpadku. Pozornost je dále věnována jednotlivým fázím insolvenčního řízení a možným způsobům řešení úpadku. Na konci teoreticko-metodologické části jsou vymezeni účastníci insolvenčního řízení, jejich pozice a pravomoci. V analytické části jsou hledány příčiny vzniku úpadkového stavu u hotelu Dvořák v Českých Budějovicích. Nejprve je analyzována hospodářská situace v rámci účetní evidence a výkazů hotelu. Dále je monitorován průběh a úskalí insolvenčního řízení a na závěr jsou zjišťovány a ověřovány příčiny úpadku, které vedly k likvidaci podniku. V návrhové části jsou vytyčena opatření, která mohla přinést hospodářské a finanční oživení společnosti. Na základě získaných výsledků je navrženo několik dílčích možností, které mohly zachránit činnost podniku a tím se vyhnout likvidaci hotelu a rozprodání jeho majetku.

Abstract:

This Masters´s Dissertation aims to analyse the insolvency status of a chosen housing facilitiy and the options of recovery available. The main aim of the thesis is to find the causes of the insolvency status and to propose proceedings that would help to avoid the insolvency status. The thesis is devided into three parts: theorethical- methodological, analytical and suggestion. The theorethical-methodological part deals with the historical progression of insolvency proceedings; bankruptcy law; and the specification of bankruptcy. The thesis analyses each part of the insolvency proceedings and offers possible solutions. At the end of the theorethical-methodological section, participants of the insolvency are defined, concerning their position and competence. In the analytical part we look at the reasons of bankruptcy at the hotel Dvořák in České Budějovice. First of all, it analyses the economic situation through accounting records and statements. Then, it monitors the progress and restrictions involved in insolvency proceedings and in conclusion we identify and verify the causes of liquidation. In the suggestion part we set out certain provisions which could help to regenerate the company. On the basis of the results, we offer some proposals which could save the hotel from liquidaton and from the sale of its assets
