Abstract:

Tato diplomová práce "Sociální družstvo" se věnuje tématu sociálního družstva jakožto právnické osoby a typu sociálního podniku, jež byl do našeho právního řádu nedávno zařazen, a je tak prvním typem sociálního podniku ukotveným v české legislativě. Práce si klade za cíl popsat uceleně téma sociálního družstva, čehož jsem se snažila dosáhnout skrze přiblížení témat sociální ekonomiky a sociálního podnikání v první části této práce a poté pokračovala především legislativním vymezením sociálních družstev a sociálních bytových družstev dle zákona č.90/2012 Sb. o obchodních společnostech a družstvech. V závěru práce je popsán status obecné prospěšnosti, kterého by mohla sociální družstva nabývat.

Abstract:

The diploma thesis "Social cooperative" deals with the topic of social cooperative as a legal entity and a type of social business, which was recently added to our rule of law and is therefore the first type of social business included in the legislation of the Czech Republic. The goal of the thesis is to comprehensively describe the term social cooperative which is done by explaining the topics of social economy and social entrepreneurship in the first part of the thesis and the legal definition of the social cooperatives and social housing cooperatives according to law nr. 90/2012 about commercial corporations and cooperatives. The status of public utility is described in last part of the thesis, which is the status the social cooperatives could gain.
