Executory Process - Selected Issues

Abstract:

Tato bakalářská práce se zabývá exekučním řízením a problémy, které vznikají v případě střetu exekucí. Hlavní cíl této práce je zaměřen na praktické problémy, které vznikají při souběhu více exekucí a problémy, které vznikají při provádění exekuce srážkami ze mzdy a zároveň přikázáním pohledávky z účtu. V druhé části je snaha o nalezení vhodných způsobů, kterými se může dlužník v takových situacích bránit. Jedná se o situaci, kdy se povinný může ocitnout zcela bez finančních prostředků. Pro lepší pochopení této problematiky, bylo nutné se v první části seznámit s obecnou právní úpravou exekučního řízení a s jednotlivými druhy exekucí.

Abstract:

This bachelor thesis deals with the executory process and problems that arise in the case of conflict of execution. The main aim of this thesis is focused on the practical issues that arise from conflict of two or more executions and issues that arise during the execution deductions from wages, alongside claim on bank account. In the second part, we tried to find appropriate ways in which the debtor may defend in such situations. This is a situation where the obliged party may find themselves completely without financial resources. But to understand this issue, it was necessary in the first part to be familiar with the general rules of executory process and with different types of executions.
