Private Law Aspects of Natural Law and Natural Rights

Abstract:

Předkládaná disertační práce je věnována vztahu přirozeného a soukromého práva. Cílem je předložit zjevné i skryté dopady přítomnosti přirozených práv v novém občanském zákoníku. Nový soukromoprávní kodex představuje v každém čase velkou výzvu, nejinak tomu bylo v případě občanského zákoníku, který se díky výslovnému zakotvení přirozených práv člověka v textu zákona stal vysloveně juristickou zajímavostí, pomineme-li tradiční ustanovení § 16 ABGB. Jedná se o zajímavý počin, zejména ve světle horizontálního působení základních práv, která si nyní budou zřejmě s výkladem přirozenoprávním v soukromoprávních vztazích konkurovat. Práce je zpracována formou analýzy, která nejprve formuluje obecná východiska obou systémů, poté přes vzájemné interakce, dospívá ke konkrétním možným dopadům. Všechny závěry jsou zároveň vedeny v kritickém kontrastu s teoriemi, které smysl přirozených práv v rámci právní vědy trivializují. Na závěr autorka předkládá soubor myšlenkových experimentů, které přiblíží možné přirozenoprávních aspekty v právu občanském.

Abstract:

This thesis is dedicated to the idea of natural law and natural rights in the Civil Code. Correct interpretation of the reference of the natural rights theory and its implementation in the context of the new Civil Code represents a challenge for discussion and the need to deal with the intention of the legislature, which was vaguely submitted. If one asks, whether the theory of natural rights was dead, or at least fundamentally obsolete, we must answer that it is not. Or at least not entirely. Current jurisprudence (juris prudentia), which divides the actors traditionally right to legal positivists and naturalists, refers to a number of major proponents of the idea of natural law. Live is also called modern natural law theory, which recently formulated J. Finnis and his followers. There are more possible definitions of natural law at this moment, we consider only those that are common to most theories, and capture the essence of natural rights. These statements will be the nature of the application test whether or not a natural right of man and constitute a default view in the case of a positive interpretation of the legal definition of natural rights.
