Abstract:

Tato bakalářská práce zpracovaná v anglickém jazyce se zaměřuje na analýzu nového současného přístupu EU k ochraně investic ve vztahu k třetím zemím, konkrétně k USA. Vzhledem k širokému rozsahu daného tématu je práce více zaměřena na přesun pravomocí k uzavírání smluv o ochraně investic z členských státu na Evropskou unii. Práce má za cíl osvětlit jaký důsledek tato skutečnost bude mít pro bilaterální investiční dohody uzavřené s třetími zeměmi, vzhledem k vyjednávání nových smluv ochraňující investice mezi Evropskou unií a Spojenými státy americkými. Důraz je také kladen na novou politiku EU vzhledem k obchodu a investicím, která má být mimo jiné prosazována při vyjednávání Transatlantického obchodního a investičního partnerství.

Abstract:

This bachelor’s thesis is focused on analysis of the new investment protection approach of the EU in relation to third countries, particularly the USA. Given the broad range of aspects of this topics, and the scope of this thesis, the work is focused on the transfer of competences over treaty-making related to investment protection from the Member States to the EU. Work aims to shed light on what effect this will have on existing bilateral investment treaties concluded between the Member States and third countries. Emphasis is placed on the new EU trade and investment policy, which should be implemented in the Transatlantic Trade and Investment Partnership.
