Land as an object of Neighbour's relationships

Abstract:

Sousedská práva označují soubor práv a povinností, která mají mezi sebou jak vlastníci sousedících nemovitostí, tak se mohou vztahovat i na kohokoliv jiného, kdo je oprávněn určitou nemovitost či pozemek užívat, např. na základě nájemní smlouvy. Bakalářské práce pojednává o problematice sousedských vztahů jak z hlediska občanskoprávní, tak i se zaměřením na stavební zákon. V první části se zaměřím na vymezení základních pojmů související se sousedskými vztahy. V další rozsáhlejší kapitole budu pojednávat o jednotlivých zásazích do sousedských práv, jejichž ochrana je poskytována občanským zákoníkem a to především ust. § 127. V navazující části se pokusím nastínit i jiný pohled na sousedská práva než je typický občanskoprávní a to se zaměřením na stavební zákon. V bakalářské práci je také zahrnuta kapitola se zaměřením na ochranu sousedských práv. Závěrečná část se zabývá srovnáním nového občanského zákoníku se stávající právní úpravou, kde se budu snažit nastínit změny související s danou problematikou.

Abstract:

Neighbour´s Rights refer to a set of rights and obligations which have among themselves as owner of the neighbouring real estate, they may also apply to anyone else who is entitled to use the specific real estate or land, for example on the basis of the lease contract. The Bachelor thesis deals with legal regulation of neighbourly relations, namely in terms of Civil and Building Law. In the first part I will focuse on the definition of the basic concepts related to the neighborly relations. In other broader chapter I'll discuss each of the interventions in the Neighbour´s Rights whose protection is provided by the Civil Code specially in § 127. In the following section, I will try to set a different view of the Neighbour´s Rights than is the typical according to Civil Law, I will focuse on the Building Law. In the Bachelor thesis is also a chapter which is concerned with the enactment of Neighbour’s Rights protection. The final part deals with the comparison of the New Civil Code with the existing legislation, which I will try to focuse on the changes related to the issue.
