Unfair competition in term of economic competition

Abstract:

Tématem diplomové práce je nekalé soutěžní jednání v rámci hospodářské soutěže se zaměřením na teorii a praxi. V teoretické části se práce zabývá vymezením základních pojmů a jejich právní úpravou v České republice. Avšak nejedná se jen o výčet právních předpisů a jejich komentář, ale i o velké množství příkladů, které jsou uvedeny pro lepší srozumitelnost celého tématu. V praktické části je rozebrána konkrétní soudní kauza, která nám ukazuje postup žalobce, žalovaného i soudu v nekalosoutěžním sporu. Cílem tohoto rozboru je ukázat nekalou soutěž i z praktického hlediska. Hlavním cílem práce je vytvořit komplexní náhled na danou problematiku v teoretické části a následně rozebrat konkrétní kauzu v praktické části.

Abstract:

This paper’s topic is unfair behaviour in scope of business competition. The thesis covers both the theory and practice of such misbehaviour. The theoretical part identifies the basic terms and the way they are provided for in the Law of the Czech Republic. However, the text does not merely show a list of the legal provisions and the applicable comments, but it also offers a great deal of examples that are supposed to illustrate the issue and assist the reader to understand. The practical part of the paper details a particular case, showing how all three stakeholders (the prosecutor, the defendant and the court) acted through an unfair competition dispute. The aim of the analysis is to document the wrong-doing also in practice. The main target of the thesis is to create a complex insight into the issue in the theory part and to analyze a specific case in the practical part which follows.
