Abstract:

Diplomová práce „Sport a právo“ se zabývá právními aspekty sportu v prostředí vnitrostátního práva České republiky a práva Evropské unie. V první části je vymezen vztah sportu, potažmo sportovních norem, a práva jako jednoho z nástrojů jeho regulace. Druhá kapitola se věnuje vnitrostátní právní úpravě sportu jak z pohledu de lege lata, tak z pohledu de lege ferenda s ohledem na novou koncepci státní podpory sportu v České republice. Tato nová koncepce deklaruje vůli vytvořit nový komplexnější zákon o sportu a zvýšení státní finanční podpory sportu. S ohledem na tuto deklarovanou vůli jsem se snažila vytvořit doporučení pro právní úpravu sportu de lege ferenda jednak na základě inspirace v zahraniční legislativě, tak na základě vlastní zkušenosti. V poslední části je zmapován vývoj vztahu Evropské unie k právnímu postavení sportu, jenž momentálně vrcholí přijetím samostatného článku o sportu ve Smlouvě o fungování Evropské unie. Lisabonskou smlouvou došlo k 1. prosinci 2009 k vytvoření nových kompetencí Unie v oblasti sportu, jejichž cílem je podporovat evropská hlediska sportu a rozvoj jeho evropského rozměru. V závěru práce jsou naznačeny budoucí kroky Evropské unie v této oblasti.

Abstract:

The topic of this thesis is „Sport and law“, with particular regard to the legal aspects of sport at the national and the European Union levels. This topic is highly up-to-date thanks to the Treaty of Lisbon in which a new article, relating to sport, has been included. Since then, the European Union has been newly granted the competence to govern certain areas relating to sport. The first section of the thesis deals with the relation of law to sport and sports rules in general. In the second section, I begin to discuss the national legal regulations of sport de lege lata which have been introduced and then, with regards to the upcoming adoption of a new conception of the state support of sport, I recommend some potential changes of the statute of sport de lege ferenda. These recommendations are made on the grounds of inspiration from foreign legislation and an experience from my own competitive sport career. The fundamental third section of my thesis focuses on the evolution of the relation of the European Union to legal aspects of sport which has culminated in the adoption of the article on sport in the Treaty on the Functioning of the European Union.
