Juridical Institutes with the Element of Aggravation in the Czech Penal Code

Abstract:

Předmětem předkládané práce je rozbor institutů s prvkem asperace v užším slova smyslu), které jsou nyní součástí nově přijatého trestního zákoníku. Asperační způsob trestání, při němž dochází k asperaci(tj. zostření) horní hranice výchozí trestní sazby lze fakultativně aplikovat v případě postihu kvalifikovaného vícečinného souběhu(vícečinného souběhu většího počtu trestných činů) a recidivy zvlášť závažného zločinu (která je předpokladem mimořádného zvýšení trestu odnětí svobody). V případě postihu pachatelství trestného činu spáchaného ve prospěch organizované zločinecké skupiny je relevantní trestní sazba bezdalšího zostřována obligatorně. Samotný text předkládané práce je ve své nejvyšší úrovni strukturován do tří hlavních částí. První část se zabývá detailním rozborem jednotlivých institutů s asperačním prvkem, v rámci části druhé se autor snaží poukázat na vybranou problematiku spojenou s praktickou aplikací jednotlivých institutů s asperačním prvkem, část třetí potom představuje asperační a jiné zvláštní způsoby trestání vybraných forem trestné činnosti v historických a geografických souvislostech. Práce je opatřena rovněž úvodem do zvolené problematiky a závěrečnou kapitolou obsahující úvahy „de lege ferenda“.

Abstract:

New Czech Penal Code allows the juridical aggravation of the penalty of imprisonment in certain circumstances. These circumstances are in a form of specific juridical institutes defined by law; the Czech Penal Code allows the aggravation in the case of sentencing for the multiple real concurrence of the crimes, especially serious recidivism and in the case of sentencing for the intentional crime committed in favour of the organized criminal group. The presented thesis analyses abovementioned juridical institutes with the element of aggravation. Relevant text is basically structured into three main parts. The first part is focused on the detailed analysis of the relevant juridical institutes with the element of aggravation, the subject matter of the second part are the chosen problems related with the application of the aggravation, the third part contains historical and geographical aspects related to the core topic of the thesis. At the beggining the thesis also contains introduction into the chosen issue and at the end results in the general conclusion and recommendations „de lege ferenda.
