Comparison of consumer protection, and especially consumer protection against unfair competition in the US and the Czech Republic

Abstract:

Tato bakalářská práce na téma "Srovnání ochrany spotřebitele, a především ochrany spotřebitele proti nekalé soutěži v USA a v ČR" analyzuje společné vlastnosti a rozdíly právních úprav obou zmíněných států a ohodnocuje úroveň ochrany spotřebitele proti nekalé soutěži, stejně jako úroveň ochrany spotřebitele obecně. V závěrečné kapitole jsou právní úpravy srovnány nejen z pohledu hmotného práva, ale také z pohledu statistik soudů v obou zemích, což pomáhá zodpovědět otázku na jaké úrovni se nacházejí právní úpravy obou zemí z hlediska ochrany spotřebitele. Závěrem této práce je, že navzdory odchylkám jak v úpravě hmotného práva, tak rozdílům ve statistikách soudů je ochrana spotřebitele proti nekalé soutěži v obou zemích na podobné úrovni.

Abstract:

This bachelor's thesis on topic "Comparison of consumer protection, and especially consumer protection against unfair competition in the US and the Czech Republic" analyzes the common features and differences of legislation of both countries and evaluates the level of consumer protection against unfair competition, as well as the level of consumer protection in general. In the final chapter, the legislation are compared not only from the point of view of substantive law, but also from the point of view of court statistics in both countries, which helps answer the question of what level the legal regulations of both countries are in terms of consumer protection. The conclusion of this work is that despite the differences in both the regulation of substantive law and differences in court statistics, consumer protection against unfair competition in both countries is at a similar level.
