Smernica MiFID účinná od 30. 4. 2004 bola do českého právneho poriadku transponovaná až ku dňu 1. 7. 2008 zákonom č. 230/2008 Sb., ktorým sa novelizoval zákon č. 256/2004 Sb., o podnikaní na kapitálovom trhu. Priniesla významné zmeny v oblasti vymedzenia investičných služieb a investičných nástrojov, zaviedla novú kategorizáciu zákazníkov.
