Systemic Approach to Acquiring Information by a Bankruptcy Trustee

Abstract:

Diplomová práce si klade za cíl zhodnotit možnosti informačního zabezpečení insolvenčního správce. Postavení insolvenčního správce je od počátku roku 2008 zcela jiné, a to především díky novému insolvenčnímu zákonu. Ten má za cíl mimo jiné zrychlit konkursní řízení a zlepšit postavení věřitelů. Klíčový je nový zákon také v tom, že přináší možnost reorganizace podniku. Ta je výhodou především pro věřitele, kteří se díky ní mohou domoci postupného uspokojování svých pohledávek při zachování provozu dlužníkova podniku. Pro úspěšnou reorganizaci, jejíž plán schvaluje soud, musí insolvenční správce úzce a efektivně komunikovat s věřiteli a všemi jejich orgány. Pouze v případě, že insolvenční správce bude mít komfortní informační zabezpečení, může efektivně pracovat pro věřitele. Hlavní novinkou, kterou insolvenční zákon přináší na poli informačního zabezpečení, je elektronický insolvenční rejstřík. Ten mimo jiné obsahuje seznam insolvenčních správců, seznam dlužníků a insolvenční spisy. Rejstřík je veřejně přístupný s výjimkou údajů, které přesně stanoví zákon. Do rejstříku mohou zájemci volně nahlížet a pořizovat si z něj kopie a výpisy. Informačním zdrojem jsou pro insolvenčního správce také státní orgány a úřady. Z jejich databází získává správce údaje o poměrech dlužníka na základě žádostí o součinnost. Každý insolvenční správce by se měl naučit nejen využívat veškeré možné insolvenční zdroje, ale také se soustavně vzdělávat.

Abstract:

The goal of this dissertation is to evaluate possibilities concerning provision of information for the bankruptcy trustee. The role of the bankruptcy trustee changed considerably as of 1 January 2008 largely due to the new bankruptcy law. The law aims to speed up bankruptcy proceedings and improve the position of creditor. The option of enterprise reorganization introduced by the new law is also key. This is advantageous mainly for creditors, who can thus achieve gradual pay-off of their claims enabling the debtor’s enterprise to continue operating. In order to undertake a successful reorganization the bankruptcy trustee must communicate intensively and effectively with the creditors and all of their bodies. That is why the bankruptcy trustee needs sufficient provision of information, only then can he/she work effectively for the creditors. The electronic bankruptcy register is the main innovation in the area of provision of information brought about by the new law. Above all, the register contains a list of bankruptcy trustees, a list of debtors and bankruptcy protocols. The register is public except for the data specified by law. Anyone can freely look up information in the register and make copies or official print-outs of its contents. State institutions and offices also act as information sources for the bankruptcy trustee. The trustee can acquire information on the debtor from these sources based on the Application for Co-ordinated Action. Every bankruptcy trustee should not only learn to take advantage of all available bankruptcy information sources but also keep educating themselves
