Abstract:

Mezinárodní výbor a myšlenka, kterou představuje, byla ve své době zcela jistě jedinečná a do té doby nerealizovaný projekt, jak bychom řekli v dnešním slova smyslu. Nedomnívám se, že by se některé osoby v 19. a posléze v první polovině 20. století nevěnovali charitativní činnosti, ovšem vždy to byli jednotlivci ať už na vnitrostátní rovině, tím spíše na mezinárodní úrovni. Mezinárodní výbor je bezesporu mezinárodní nevládní humanitární organizace a vzhledem ke skutečnosti, že v žádném mezinárodním smluvním dokumentu nelze nalézt ustanovení o tom, že by byl zřízen souhlasným projevem vůle subjektů mezinárodního práva a dokonce Ženevské úmluvy spíše ve svých společných ustanoveních článku 9 také vycházejí z fakticity, když uvádějí formulaci: . . . Mezinárodní výbor Červeného kříže nebo jiná nestranná humanitární organizace . . ., a tak se domnívám, že na případ Mezinárodního výboru nejsou aplikovatelné ani jedna z dominantních teorií mezinárodního práva snažící se řešit mezinárodněprávní subjektivitu mezinárodních organizací, tj. ani subjektivní, ani objektivní a zřejmě ani presumptivní. V případě Mezinárodního výboru se domnívám, že mezinárodní společenství zastoupené státy, mezinárodními organizacemi a jednotlivci prostřednictvím udělení různých statusů, výsad a imunit, uznání určité výjimečnosti v rámci mezinárodních smluvních dokumentů, nebo respektování činnosti s následným vznikem obyčejového pravidla projevilo vůli považovat Mezinárodní výbor za subjekt mezinárodního práva, při čemž tato skutečnost je podpořena jednotlivými oprávněními a povinnostmi, kterých je Mezinárodní výbor držitelem počínaje od práva uzavírat mezinárodní smlouvy, vysílat své zástupce do jiných zemí než je země jeho sídla, pokračujíce oprávněními udělenými Mezinárodnímu výboru skrze další instrumenty mezinárodního práva a konče různými výsadami a imunitami, které Mezinárodní výbor požívá stejně jako je tomu u ostatních subjektů mezinárodního práva, tj. u států nebo mezinárodních mezivládních organizací; nemluvě o významné roli Mezinárodního výboru jako iniciátora mezinárodní smluvní úpravy různých skutečností v rámci mezinárodního práva humanitárního a v dalších oblastech činnosti.

Abstract:

The International Committee of the Red Cross was established in 1863 on the ground of at that time lacking idea of providing help and relief to suffering persons. The founders of that time called the International Committee for Aid to Wounded Soldiers had represented two little bit different thoughts on which could be based the project of providing help and relief to suffering persons. One of these thoughts was the establishment of the relief societies in each country or power participating at this project, the other was, the establishment of a completely new concept of the treatment with persons during armed conflicts, especially determination of the set of principles concerning the law of armed conflicts, treatment with prisoners of war or civilians. At the beginning, the first thought had won but the other was joined in the activities of the International Committee of the Red Cross (hereinafter called International Committee) during the next several decades. From the legal point of view the character of the International Committee has two faces. One of the faces representing international non-governmental organization as the entity posessing the legal personality and being the subject of the national law; the other face representing international organisation as the entity possibly posessing the international rights or duties, posessing international legal personality and being the subject of the international public law. The year of 1949 meant the most important moment in the history of the International Committee because four Geneva Conventions were adopted. These Conventions approved the specfic role of the International Committee and especially its humanitarian activities in the form of the right of the iniciative. The right of the iniciative was not the only right contained in Geneva Conventions, there was also the right to serve as the protecting power neutral and independent intermediary. It started to be necessary to spread the representation of the International Committee and also to spread the area in which the International Committee could fulfill its activity in a proper way. In order to be able to pass its purposes and aims, the International Committee started concluding the headquarters agreement with the states or the representative of the states belonging to the specific geographical region. These agreements have two purposes to establish the proper diplomatic mission of the International Committee and then to guard and promote the international humanitarian law including its principles and to strenghten the position of the International Committee in the field of humanitarian work and the principles of providing this kind of help. More Switzerland and the International Committee also regulated the mutual relations in the headquarters agreement in 1993. The conclusion of this kind of agreement was the sign of the recognition of the specific position of the International Committee.
