Comparing the concept of the freedom of religion and tolerance: Edict of Nantes, Letter of Majesty and Patent of Toleration

Abstract:

Práce se věnuje srovnání pojetí náboženské svobody, tolerance a pojmu náboženství v Ediktu nantském (1598), Rudolfově majestátu (1609) a Tolerančním patentu (1781). Tyto dokumenty nově definují vztah mezi náboženstvím a státem a významným způsobem upravují do té doby fungující vztah s majoritně zastoupenou katolickou církví v tehdejší společnosti. S tím se také pojí důležitá otázka náboženských projevů ve veřejném prostoru. V práci se opírám o výzkumný program Philipa Gorskiho, jehož záměrem je inspirovat sociology k historizaci debaty o kořenech sekularizace, a to zejména v období pozdního středověku a raného novověku. Teoreticky se práce opírá o myšlení Bryana Wilsona a Davida Martina. Wilson chápe pod pojmem sekularizace změnu pozice náboženství ve společnosti, kdy je náboženství vytlačováno z veřejné sféry do soukromí jedinců. Martin sekularizací rozumí posun od náboženského k politickému a zdůrazňuje význam vlivu reformace. Ve všech třech dokumentech podrobených analýze, můžeme nalézt výroky podporující tyto myšlenky. Náboženství je v uvedených dokumentech chápáno jako křesťanství a texty hovoří o stranách téhož náboženství. V dokumentech také nalézáme zmínky o tom, že náboženské zákony jsou podřízeny zákonům království, čímž dává stát jasným způsobem najevo svoji moc. Rudolfův majestát neobsahuje oproti ostatním textům žádné restriktivní opatření, a to ani vůči nekatolíkům, ani vůči katolíkům. V případě Ediktu nantského či Tolerančního patentu můžeme hovořit o utlumení role náboženství ve veřejném prostoru, přičemž Toleranční patent je v této otázce více restriktivní. Práce tak na základě srovnání politických dokumentů nabízí možnost sledování změn vztahu mezi náboženstvím a státem v raném novověku, které významně ovlivnilo chápání tohoto vztahu v moderní společnosti.

Abstract:

This thesis compares the conception of freedom of religion, the concept of tolerance, and the concept of religion in the Edict of Nantes (1598), the Letter of Majesty (1609) and the Patent of Toleration (1781). These documents define the relationship between religion and state in a new way and significantly adjust the long functioning relationship mostly represented by Catholic Church. They also deal with the important issue of the presence of religion in the public space. The thesis is based on the research program by Philip Gorski, who encourages sociologists involved in the debate over secularization to historicize more their claims about the late medieval and early modern roots of secularization. In the realm of theory, the thesis is based on Bryan Wilson’s and David Martin’s thinking. Wilson sees secularization as change in the position of religion in society due to which religion is pushed out from the public sphere into the privacy of individuals. Martin defines secularization as shift from the religious to the political and emphasizes the importance of the Reformation for this shift. In all three documents analysed in this thesis we can find evidence that support these ideas. In the analysed documents, the term “religion” as applies exclusively to Christianity but importantly, the texts speak about different sides of the same religion. They also contain references supposing that religious laws are subordinate to the laws of the kingdom, thereby state clearly shows its power. Still, the Letter of Majesty does not contain any restrictive measures against both non-Catholics and Catholics. In the case of the Edict of Nantes and the Patent of Toleration we can speak about reduction of religion in the public space and the last mentioned is more restrictive on this issue. By comparing political documents, this thesis offers the opportunity to evaluate changes in the relationship between religion and state in early modern period, which significantly influenced the understanding of this relationship in modern society.
