The Methods of Ownership Acquisition

Abstract:

Tato bakalářská práce se zabývá vlastnickým právem, konkrétně jeho počátkem tzn. nabýváním. Cílem bylo získání uceleného a podrobného přehledu způsobů nabývání vlastnictví, které připouští česká právní úprava platná v době vytvoření práce. Součástí práce jsou i příklady z praxe a řešení problematických situací dle judikatury a porovnání některých částí stávajícího znění občanského zákoníku s návrhem zákoníku nového.

Abstract:

This bachelor’s thesis deals with ownership rights, more specifically its commencement, i.e. its acquisition. The aim of this thesis is to compile a comprehensive overview of all methods of ownership acquisition that are allowed within the Czech legal system valid at the time of the thesis elaboration. At the same time the thesis comprises real-life examples and examples of dealing with ambiguous situations according to judicature as well as comparisons of some parts of the valid Civil Code with its new draft.
