Mandatory confidentiality in health care

Abstract:

Diplomová práce se zabývá obecně problematikou povinné mlčenlivosti. Dále se zaměřuje na jednotlivé druhy povinné mlčenlivosti. Popisuje také jednotlivé skupiny údajů, které jsou chráněné mlčenlivostí. Definuje formu údajů spadajících pod povinnou mlčenlivost. Zaměřuje se také na ochranu osobních a citlivých údajů ve zdravotnické dokumentaci v souvislosti s povinnou mlčenlivostí ve zdravotnictví. V další části práce charakterizuje samotnou povinnou mlčenlivost zdravotnických pracovníků, rozsah údajů, které jsou chráněny povinnou mlčenlivostí. V závěru práce stručně porovná úpravy institutu ve vybraných zemích. Jelikož je zdravotní právo přirovnávané k nejrychleji rozšiřovaným právním oborům, tak tyto časté změny vedou ke ztížené orientaci zdravotníků v těchto předpisech. Cílem diplomové práce je přiblížit problematiku povinné mlčenlivosti ve zdravotnictví, tak aby zdravotnickým pracovníkům poskytla komplexní nástroj pro pochopení této oblasti.

Abstract:

The diploma thesis deals with issues of compulsory confidentiality in general. It will also focus on the types of mandatory secrecy. The thesis describes individual groups of data that are protected by confidentiality and also defines the form of data under mandatory confidentiality. The work will also focus on the protection of personal and sensitive data in medical records in connection with mandatory medical secrecy. The next part of the thesis characterizes the obligatory confidentiality of healthcare workers, the scope of data that is protected by mandatory confidentiality. At the end of the thesis, the institute changes in selected countries. Because health law is likened to the fastest-growing legal fields, these frequent changes lead to a more difficult orientation for health professionals in these prescriptions. The aim of the diploma thesis is to approach the issue of compulsory confidentiality in the health care system so that the health workers provide a comprehensive tool for understanding this area.
