Abstract:

Cílem práce je seznámit odbornou i laickou veřejnost s činností Probační a mediační služby ČR (dále jen PMS ČR), a v bližším pohledu seznámit s novými činnostmi této organizace, které vyplývají z nového trestního zákoníku. Cílem teoretické části práce je popsat východiska a základy nových alternativních trestů jako nedílné součásti činnosti PMS ČR, stručný nástin vývoje PMS v ČR a v EU. Teoretická část, která je koncipována jako úvod do činností PMS ČR, je spíše určena laické veřejnosti. Pro odbornou veřejnost je v této části práce uveden teoretický úvod do činností PMS ČR včetně legislativní opory těchto činností. Naopak empirická část práce by spíše měla oslovit odbornou veřejnost a to proto, že se zabývá konkrétní činností PMS ČR v zajímavém alternativním trestu, jakým je trest domácího vězení a analýzou případových studií. Adresáty tedy mohou být pracovníci jak PMS ČR, tak pracovníci v resortu justice, kteří zde mohou nalézat jistou základnu pro přehled v problematice. Práce se snaží nalézt i přesahy směrem k možným vzdělávacím činnostem pracovníků PMS ČR.

Abstract:

The goal of this work was to inform the professional and general public about the activities of the Czech National Probation and Mediation Services (hereinafter referred to as PMS CR), and to introduce new activities of this authority applied in accordance with the new Penal Code, in detail. The theoretical part is to describe the background and foundations of new alternative sanctions and penalties as an integral part of the PMS CR activities, including a brief outline of the development of PMS in the Czech Republic and the EU. The theoretical part, which is written as an introduction the the activities of the PMS CR, is rather intended for the general public understanding. In this part, professionals are provided with theoretical description of the PMS CR activities, including the legislative support of the listed activities. On the contrary, the empirical part of the study would rather attract attention of professionals, for it provides the description of the particular legal procedures conducted by the PMS CR in an nteresting alternative form of punishment which is the house arrest, and it brings analysis of the case studies. Addressees could be staff of both the PMS CR and other justice authorities who can find here some basis for a good overview of the issues. The paper also strives to identify the overlaps that would lead to the PMS CR staff training.
