Abstract:

Tato diplomová práce se zabývá problematikou korupce ve veřejných zakázkách se zaměřením na stavební trh v České republice. Popisuje jak teoretická východiska, které vedou ke korupčnímu jednání v oblasti stavebnictví, tak indikativní znaky k rozpoznávání těch nejrizikovějších míst v rámci celého životního cyklu veřejné zakázky. Cílem práce je na základě zmapování procesu zadávání veřejných zakázek ve stavebnictví navrhnout možnosti řešení, jak co nejvíce omezit prostor pro korupční jednání. Prostředkem zjištění korupčního prostoru byla případová studie zaměřená na konkrétní veřejnou zakázku. Z případové studie vyplynulo, že korupční prostor se nachází ve všech fázích veřejné zakázky a za současných, legislativních podmínek je velmi těžké takovému jednání předcházet, natož zabránit. Součástí práce je proto nejenom zamyšlení nad současnými formami korupce, ale i nad možnostmi, jak jim čelit, třeba i za pomoci využití nejnovějších poznatků z výzkumu a vývoje v oblasti informačních technologií a umělé inteligence.

Abstract:

This diploma thesis deals with the issue of corruption in public procurement in construction industry in the Czech Republic. It describes both the theoretical background that leads to corrupt behaviour in the construction sector and indicative signs to identify the riskiest points within the whole life cycle of a public procurement. Based on the mapping of the public procurement process in the construction sector, the aim of the paper is to propose possible solutions to reduce the scope for corrupt behaviour as much as possible. The means of identifying the corruption space was a case study focused on a specific public procurement. The case study showed that corruption space is found at all stages of public procurement and under the current legislative conditions it is very difficult to prevent, let alone avoid, such behaviour. Therefore, the thesis includes not only a reflection on the current forms of corruption, but also on the possibilities of counteracting them, for example by using the latest findings from research and development in the field of information technology and artificial intelligence.
