Charles de Montesquieu and The idea of separation of powers

Abstract:

Tato bakalářská práce se zabývá Charlesem de Montesquieu a jeho teorií dělby moci. Práce se věnuje životu Charlese de Montesquieu, jeho nejvýznamnějším pracím, okolnostmi, které ho vedly k vytvoření uvedené teorie. Zabývá se vývojem absolutismu za vlády Ludvíka XIV., životem ve Francii, společností. V bakalářské práci je také rozpracovaná teorie forem vlády dle Montesquieho. Závěr pojednává především o anglické ústavě, o modelu anglické monarchie, který Montesquieu tak vyzdvihuje. Ukazujeme, jak vznikla teorie dělby moci, která je dnes nezbytnou součástí každé demokratické ústavy.

Abstract:

This bachelor thesis deals with Charles de Montesquieu and his theory of the separation of powers. The work copes with life of Charles de Montesquieu, his most important tracts, circumstances that influenced him on creating the theory. It deals with the development of absolutism under rule of Louis XIV., life in France, the society. There is a theory of forms of government according to Montesquieu developed in this bachelor thesis. The conclusion deals primarily with English constitution, model of English monarchy, which was so emphasised by Montesquieu.
