Abstract:
The legal regulation of the duty to file for insolvency in the Czech Republic is somewhat ambiguous, and data repeatedly show that corporate debtors often file several years late. Inspired by German legislation, this diploma thesis analyzes the legal framework governing the duty to file for insolvency in both the Czech Republic and Germany, identifying potential sources of inspiration.
