Tato bakalářská práce se věnuje smluvní pokutě a možnosti jejího snížení ze strany soudu. Smluvní pokuta je institut široce využívaný v obchodněprávních i soukromoprávních vztazích, i tak však není její právní úprava příliš široká, především, co se týče samotné moderace soudy, a proto je důležité sledovat nejen právní předpisy, ale taktéž judikaturu Nejvyššího soudu. This bachelor's thesis deals with the contractual penalty and the possibility of its reduction by the court. A contractual penalty is an institute widely used in commercial and private law, even so, its legislation is not very broad, especially as regards the mere moderation of the courts and therefore it is important to follow not only the legislation but also the case law of the Supreme Court.
