Abstract:

Cílem diplomové práce je vyhodnotit nejčastější formy faktorů motivujících k vedení kreativního účetnictví či páchání nelegálních postupů a s nimi související rizikové prvky vnitřního kontrolního systému účetních jednotek pomocí analýzy judikatury Nejvyššího soudu České republiky. Nejprve jsou definovány základní pojmy týkající se problematiky. Následně je stručně popsán současný stav poznání v oblasti motivace k páchání podvodného jednání v účetnictví. Výzkumná část práce spočívá v analýze judikatury Nejvyššího soudu a také v modelové situaci znázorňující podvodné jednání formou kreativního účetnictví. Po provedení analýzy byly identifikovány konkrétní faktory, jenž se prokazatelně opakují, a na které je možné se zaměřit při snaze o jejich potlačení.

Abstract:

The aim of the diploma thesis is to evaluate the most common forms of factors motivating individuals to the use of creative accounting or illegal practices and risk-related elements of the internal control system of entities by an analysis of the case law of the Supreme Court of the Czech Republic. First, the basic concepts related to the issue are defined. Then, the current state of knowledge in the field of motivation to commit accounting fraud is briefly described. The research part of the thesis consists of the analysis of the case law of the Supreme Court and of the model-based situation showing creative accounting fraud. Following the analysis, specific factors, that are provably recurring, and which can be focused on to suppress them, are identified.
