Abstract:

Vozidlo je v našem případě pouze škodním nástrojem. Škůdcem je řidič. V trestním právu se toto také běžně praktikuje, za škodu žádný soud neodsoudí vozidlo nebo pojistníka, ale řidiče. Je zřejmé, že existuje jakási příčinná souvislost mezi nehodou a řidičem. Tato úvodní teze by měla sloužit jako představení tématu,kterým bych se chtěl zabývat ve své diplomové práci. Povinné ručení jako pojištění osob je kapitolou do současné doby nerealizovanou a nijak detailně nepopsanou. Trh ukazuje, že minimálně pokus a zkoumání tohoto problému je na místě. Údaje o řidiči, jeho přestupcích, dopravních nehodách, řidičském oprávnění jsou podrobně sledovány dopravně správními agendami příslušných úřadů. Spolupráce s pojistiteli by tedy neměla být nijak problematická. Naopak spolupráce by mohla oběma stranám, jak státní správě, tak pojišťovnám přinést řadu výhod. Na jedné straně detailní přehled informací a ekonomická síla na straně druhé, by mohlo přinést zavedení nového systému pojištění.

Abstract:

The vehicle in our case is only the injury elimination tool. Pest is the driver. There is a comon practice in criminal law, that in the court condemn any vehicle or policy holder, but the driver. It is clear that there is a kind of causal link between the accident and the driver. The initial argument should be instrumental as a presentation of the issue, which would be concerned in my thesis with. Compulsory liability insurance for individuals is theme unrealized and not described until now. The market shows us, that the attempt at least and study of this problem is worthy theme for my thesis. Driver`s data, his misdemeanors, traffic accidents, driving licence are closely monitored by traffic administrative agendas of relevant authorities. Cooperation with the insurers therefore should not be in any way problematic. On the contrary, cooperation of the two parties, both government and insurance companies make a number of advantages. On the one hand, a detailed overview of information and economic power on the other hand, could bring the implementation of the new insurance scheme.
