The Defence Right

Abstract:

Právo na obhajobu je jedno ze základních práv, které náleží obžalovanému a které musí být dodržováno v průběhu celého trestního řízení. Tato diplomová práce se zabývá právem na obhajobu a je rozdělena do šesti částí. První se zabývá prameny práva mezinárodního i českého, které obsahují právo na obhajobu a řadí ho mezi základní práva. Druhá část se věnuje samotnému pojmu práva na obhajobu, materiální a formální obhajobou, nutnou obhajobou a zvláštní úpravou s ohledem na mladistvé. Třetí část rozebírá jednotlivé složky práva na obhajobu. Další část se zabývá problematikou obhájce a práva na obhajobu. Je zde zmíněno, jak se advokát stane obhájcem a kdy může být naopak z trestního řízení vyloučen. Právo na obhajobu by samo o sobě nemělo žádný význam, pokud by nebylo účině zajištěno, aby se ho mohl obžalovaný dovolávat. Tato problematika je upravena v páté části této diplomové práce. Šestá a zároveň poslední část shrnuje současnou právní úpravu a obsahuje návrhy de lege ferenda.

Abstract:

The defence right is one of the fundamental law that belongs to the accused person, which must be respected during the whole criminal proceeding. This diploma work is focus on the defence right and is divided into six parts. The first one features the sources of the law (international and czech) that contains the defence right and classifies him between fundamental rights. The second part is dealing with the conception of the defence right, material and formal defence, compulsory defence and special legislation with regard to the juvenile. Third part is about individual components of the defence right. The next part analyses questions of the defending counsel and the defence right. There is mentioned how the lawyer can become the defending counsel and when he can be excluded from criminal proceeding. The defence right by itself haven´t any sense, if the defence right isn´t safely guaranteed, than the accused isn´t able to claim his demand on this right. This question is contained in the fifth part of this thesis. The sixth and the least part is the summary of the recent legal regulation and contains the proposals de lege ferenda.
