The Competitive Clause in an Employment Relationship

Abstract:

Bakalářská práce analyzuje historický vývoj konkurenční doložky v pracovním poměru od vzniku Československa do současnosti, její změny, dopady na vztah zaměstnavatel – zaměstnanec v čase trvání pracovního poměru a v době po jeho ukončení. Tato práce je určena hlavně zaměstnavatelům. Je koncipována tak, aby každý po jejím prostudování získal přehled o tom, jak se vyvíjela až do podoby jak ji známe z poslední úpravy. Hlavním smyslem je upozornit na možné chyby při sjednávání konkurenčních doložek a ušetřit tak nemalé peníze, jak na straně zaměstnavatele, tak na straně zaměstnance při vedení soudních sporů, způsobených špatným pochopením zákona. První část je věnována právní úpravě v období při vzniku samostatného Československa, vzniku zákona o zaměstnancích. Dále změny tohoto zákona až do schválení zákona 65/1965 Zákoníku práce z června 1965. Další část popisuje vývoji po roce 1989, přelomový zákon č. 155/2000 Sb přes zákon č. 262/2006 Sb., Zákoník práce až do úpravy v roce 2012, včetně popisu některých zajímavých nálezů Nevyššího soudu České republiky. Poslední části této bakalářské práce se věnují shrnutí poznatků z předcházející části a konečné doporučení jak při sestavení konkurenční doložky postupovat a zda je vhodné vůbec konkurenční doložku v některých případech sjednávat.

Abstract:

The Bachelor thesis analyzes the historical development of the competitive clause in an employment relationship since the establishment of Czechoslovakia until today, its changes, the impact on the relationship of employer - employee over time duration of employment and at the time after its termination. This work is determined primarily to employers. The work is designed so that everyone after its study of had an overview of how to evolved shape into as we know it from the last version. The main purpose of the thesis is to draw attention to the possible errors in the negotiation of competing clauses in order to save the money of the employers and employees in litigation caused by incorrect understanding of the law. The first part is devoted to the legislation at the time, an independent Czechoslovakia, the application of the Act to the employees. Other amendments to the effectiveness of the Act 65/1965 Labour Code in June 1965. The other part describes the development of the 1989 a breakthrough Act No. 155/2000 ECR through Act No. 262/2006 ECR., The Labour Code to modifications in 2012, including a description of some of the interesting findings of the Supreme Court of the Czech Republic. In the last part of this work is devoted to a summary of the findings from the previous section as a final recommendation in the preparation of competition clause, and when it is appropriate competition clause in some cases to arrange.
