Abstract:

Tato diplomová práce se zabývá právy občanů obce. Podstatou práce jsou práva občana obce, jimiž disponuje ve vztahu k obci. Tato práva má téměř každý z nás a může prostřednictvím nich ovlivňovat bezprostřední okolí kde žije, pracuje nebo studuje. Smyslem této práce je tato práva popsat, analyzovat a následně blíže nahlédnout do předmětné problematiky a blíže rozpracovat instituty, které s tématem souvisí. Práce je členěna na pět kapitol a první kapitola se zabývá historickým vývojem práv občanů obce. Toto období počne v roce 1848 a bude zakončeno aktuální právní úpravou s malým náhledem do mezinárodní úpravy spočívající v Evropské chartě místní samosprávy. Druhá kapitola se bude zabývat osobě občana ve vztahu k obci. Jedná se o stručný nástin občana jakožto základního prvku obce a porovnání osoby občana a obyvatele. Samotná podstata práce bude ve třetí, čtvrté a páté kapitole. Třetí kapitola se bude věnovat aktivnímu a pasivnímu volebnímu právu a právu hlasovat v místním referendu. Snahou bude zaměřit se vždy na určité problematické skutečnosti a věci, které s tímto tématem souvisí. Čtvrtá kapitola se bude týkat práva občana obce vyjadřovat se na zasedání zastupitelstva obce a práva na získávání informací o činnosti obce, kde bude podstatou zejména způsob uplatňování tohoto práva a související problematika. Poslední kapitola, pátá, se bude věnovat právu občana obce na projednání určité záležitosti v samostatné působnosti obce, možnosti podávání návrhů, připomínek a podnětů. Bude se jednat zejména o způsob a průběh uplatnění těchto práv s následnou vzájemnou komparací.

Abstract:

This thesis deals with the rights of municipal citizens. The essence of the work are rights of a citizen at disposal towards township. Such rights are available to nearly everyone, using which one can affect the close surroundings where they live, work or study. The goal of this thesis is to describe and to analyse these rights, followed up by taking a closer look at the subject matter, as well as provide further details about institutions closely related to the subject. The thesis is divided into five chapters. The first focuses on historical evolution of the rights of municipal citizens. This period begins in the year 1848, and ends with the current legislation with a small insight into international legislation resting in the European Charter of Local Self-Government. The second chapter deals with a citizen as a person in relation towards their township. It provides a brief outline of a citizen as a basic element of a township and compares a citizen with an inhabitant. The main essence of the work itself is covered in chapters three, four and five. The third chapter is dedicated to the active and passive suffrage and to the right to vote in a local referendum. The goal is to focus on problematic facts related to this topic. The fourth chapter relates to the right of a municipal citizen, to express oneself on a council meeting and to be able to obtain information about the township, whose essence is especially the way to apply this right, and related problematics. Last chapter, the fifth, focuses on the citizen's right to discuss certain matters on independent competence of the municipality, possibilites to submit proposals, comments, and initiatives, keeping main focus on the ways and courses of applications of those rights with followup comparison.
