Abstract:

Cílem této diplomové práce je podat přehledný obraz programu, který se již půl století řadí mezi nejkontroverznější témata ve Spojených Státech ― Affirmative Action, do češtiny často překládaný jako pozitivní diskriminace. Co se týká podoby tohoto programu, zatím nebylo dosaženo jednotného názoru a zdá se, že ani v nejbližších několika letech není tento cíl splnitelný. Z tohoto důvodu není účelem práce říci, zda program zvaný Affirmative Action je či není na svém místě, nebo zda funguje či nikoliv. Záměrem je spíše dovolit každému, kdo má zájem, získat přehled a pochopit jeho smysl. Hlavní část práce je rozdělena do tří kapitol. První kapitola rýsuje historický vývoj, který vedl ke vzniku Affirmative Action, počínaje Občanskou válkou a rasovou segregací americké společnosti, až po současnost, která bohužel nepřináší uspokojivé výsledky v této problematice. Důležitou součástí této kapitoly jsou soudní procesy, které do velké míry ovlivnily současnou podobu dnešního vysokého učení. Druhá část se zabývá programem Affirmative Action obecně. Zaměřuje se na význam rasové a etnické různorodosti na univerzitách a způsoby, jak této různorodosti dosáhnout. Krom rasových preferencí, které jsou na jedné straně zatracovány a na druhé vyzdvihovány, nastiňuje i jiné alternativy. Třetí část nabízí porovnání dvou kalifornských univerzit, jedné státní a druhé privátní, a jejich zkušeností s programem Affirmative Action.

Abstract:

The aim of this diploma thesis is to provide a comprehensive review of a policy that has been an endless source of controversy in the United States over the past half-century ― affirmative action. As affirmative action concerns many spheres of public life, the main attention in this writing will be given over to higher education. As far as the character of the policy is concerned, no consensus has been reached yet and hardly any appeasing solution seems to be in sight. Therefore the aim of this paper is not to draw a definite conclusion whether affirmative action works or not, or whether it is in place or not. Rather, its intention is to offer a deeper insight into the issue for all those who wish to ‘get the gist’ of the policy. The body of the Paper is made up of three basic parts. The first part deals with the historical background behind affirmative action, beginning with the Civil War and racial segregation in the United States uptil today’s unsatisfactory state of affairs. It gives legal history behind the policy in higher education including the historic decisions in Brown v. Board of Education, Bakke v. Regents of the University of California, Hopwood v. Texas and finally the most recent Michigan cases, all of which greatly changed and shaped the face of education in America. In the second part, the attention is predominantly given over to issues concerning the character of affirmative action, meaning and importance of racial and ethnic diversity at universities, and effectivity of race-conscious admission policies. In addition, it suggests a couple of approaches towards reaching diversity on campuses others than race consideration. The final part compares two Californian institutions of higher education’s experience with affirmative action. The first institution is state and operates on a race-neutral admission policy, the other one is private and race can be considered as one of many factors in its admissions.
