Abstract:

Diplomová práce s názvem „Tvorba právního textu“ se zabývá souladem současné tvorby obecně závazných vyhlášek obcí s požadavky, které jsou na ni kladeny. Tyto požadavky práce nejprve hledá a nachází v Ústavě ČR, zákonech, judikatuře Ústavního soudu, doktrínou formulovaných obecných legislativně-technických pravidlech, meto-dických materiálech Ministerstva vnitra, jež je orgánem nad vydáváním obecně závaz-ných vyhlášek dozorujícím, a nakonec i v pravidlech spisovné češtiny. Práce si stanoví výzkumnou otázku ve znění „Jsou v současnosti vydávané obecně závazné vyhlášky obcí v souladu s požadavky, které jsou na ně kladeny?“ a nachází na ni pomocí sedmi dílčích hypotéz negativní odpověď. Příčinu tohoto stavu pak hledá v nedostatečné práv-ní úpravě, jež neobsahuje sankce za porušení povinností ze strany obce a neposkytuje občanům, na rozdíl od jiných právních řádů, možnost seznamovat se s návrhy obecně závazných vyhlášek v dostatečném předstihu před jejich projednáváním zastupitelstvem.

Abstract:

My thesis, titled „Creation of Normative Text“, inquires into conformity of contempo-rarily issued local authority bylaws with requirements that are placed on them. These requirements are found in the Constitution, statutes, case law formed by the Constitu-tional Court, legal science which formulates fundamental legislative-technique rules, methodical instructions issued by the Ministry of the Interior, which oversees local au-thorities’ lawmaking, and finally, requirements are also searched for among grammatical rules as bylaws are to be expressed in standard, grammatically correct, Czech language. My thesis, using seven sectional hypotheses, tries to answer this research question: “Are contemporarily issued local authority bylaws in conformity with requirements that are placed on them?” The answer to the research question is negative. The blame is put on an insufficient legal regulation that lacks sanctions. Also, it does not, unlike legal systems in other countries, allow Czech citizens to acquaint themselves with local authority bylaws ahead of time before the draft is passed by the local council.
