The Safety of Assisted Contacts of Children Entrusted to Foster Care and Biological Parent

Abstract:

Moje diplomová práce se týká reálného naplňování práv dítěte, která jsou chráněna mezinárodním dokumentem – „Úmluvou o právech dítěte“. Klíčovým pojmem je způsob ochrany nejlepšího zájmu dítěte. Zabývá se dětmi, které byly biologickým rodičům z jejich péče odebrány a svěřeny do náhradní rodinné péče. Právě z důvodu naplnění a ochrany nejlepšího zájmu dítěte, mezi něž patří především bezpečí dítěte. Jednou z podob náhradní rodinné péče je pěstounská péče. Zákon pěstounům ukládá povinnost, že musí dítěti svěřenému do pěstounské péče umožnit kontakt s jeho původní biologickou rodinou a dále i rozvíjet a prohlubovat tento kontakt. Aby byl tento kontakt pro dítě bezpečný, volí se tzv. asistovaný kontakt (ten nařídit může pouze soud) nebo kontakt s asistencí, který může být realizován nejen z nařízení soudu, ale vždy, pokud hrozí, že případný kontakt bude pro dítě ohrožující, rizikový a že tak nebude zajištěno bezpečí dítěte. Moje diplomová práce dále mapuje rizikové a ochranné faktory, které napomáhají tomu, aby práva dítěte byla v co možná maximální míře naplňována a chráněna.

Abstract:

My diploma thesis concerns real fulfillment of the child rights which are protected by the international document - “Convention on the Rights of the Child”. The key concept is how to protect the best interests of the child. It deals with children who have been removed from the care of biological parents and placed in foster family care. It is precisely because of the fulfillment and protection of the best interests of the child, which include the child's safety. One form of surrogate family care is foster care. The law imposes on foster parents the obligation to allow a child in foster care to enable the contact with their original, biological family and to further develop and deepen this contact. To make this contact safe for the child, the so-called assisted contact is chosen (it can only be ordered by a court) or contact with assistance, which can be realized not only by court order, but always if there is a risk that any contact will be dangerous to the child and that the child will not be safe. My diploma thesis also maps the risk and protective factors that help to ensure that the rights of the child are fulfilled and protected as much as possible.
