The methodology and strategy of examination for starting officers

Abstract:

Diplomová práce se věnuje problematice získávání informací, jejich dokumentaci a analýze, při výsleších a podání vysvětlení, v rámci policejní praxe. Zohledňuje zásady a taktické postupy, jež je možné použít v rámci platného právního řádu České republiky, s cílem získat úplnou a pravdivou výpověď. Práce je členěna do dvou základních částí, teoretické a praktické. Teoretická část obsahuje vybrané aspekty kriminalistickoprávních vědních disciplín souvisejících s tematikou výslechů, důležitých pro začínající policisty. Jsou jimi členění výslechů, fáze a stádia výslechů, taktiky a zásady vedení výslechů s ohledem na psychologické aspekty a pravdivost. Praktická část obsahuje soubor cvičení umožňujících nácvik a osvojení si základních dovedností při získávání informací prostřednictvím výslechů a dále soubor vypracovaných otázkových okruhů, vztahujících se k nejfrekventovanějším skutkovým podstatám trestných činů policejní praxe, na místních a obvodních odděleních Policie České republiky. Cílem práce je prostřednictvím obecných analytický metod, jakými jsou indukce, dedukce a analogie, vytvořit novou, praktickou pomůcku určenou pro začínající policisty. Policisty, kteří jsou si vědomi skutečnosti, že se nelze spoléhat na vzdělání, jehož se jim dostalo absolvováním základní odborné přípravy na některém ze vzdělávacích zařízení Policie České republiky, a zohledňující současnou personální situaci uvnitř bezpečnostního sboru, která mnohdy ztěžuje, či zcela znemožňuje čerpání zkušeností a pomoci služebně starších kolegů, při příjmu oznámení nebo podání vysvětlení. Za stěžejní části práce, vedoucí k dosažení stanoveného cíle, považuji zpracované příklady postupů a činností, usnadňujících přípravu výslechu, jeho průběh, analýzu získaných informací s ohledem na pravdivost nebo lživost, soubor praktických cvičení a nakonec, soubor vypracovaných okruhů otázek, které by měly přispět k ucelenosti a úplnosti výpovědi, a tak eliminovat případné obsahové nedostatky.

Abstract:

This diploma thesis deals with the issue of obtaining information, its documentation and analysis, during interrogations and giving explanations, within the police practice. It takes into account the principles and tactical procedures that can be used within the valid legal order of the Czech Republic in order to obtain complete and truthful testimony. The thesis is divided into two basic parts, theoretical and practical. The theoretical part contains selected aspects of forensic and legal science disciplines related to the theme of interrogations, important for the beginning police. They are structured interrogations, phases and stages of interrogations, tactics and principles of conducting interrogation with regard to psychological aspects and truthfulness. The practical part contains a set of exercises allowing to practice and acquire basic skills in obtaining information through interrogations and a set of elaborated question areas related to the most frequent facts of crimes of police practice in local and districts departments of the Police of the Czech Republic. The aim of this work is to create a new, practical tool intended for novice police officers through general analytical methods such as induction, deduction and analogy. Police officers who are aware of the fact that it is not possible to rely on education received through basic training at one of the educational facilities of the Police of the Czech Republic and taking into account the current personnel situation of the security forces, when they cannot rely on the presence and assistance of more experienced colleagues in receiving notifications or explanations. I consider as the crucial part of the thesis the following examples of methods facilitating the preparation of the interrogation, its course and the analysis of the obtained information with respect to truthfulness or falsehood, a set of exercises and finally a set of elaborated groups of questions which should contribute to the coherence and completeness of the testimony and thus eliminate any content deficiencies.
