Offences against Religion in the Regional Court in Olomouc between the Years 1918 and 1921

Abstract:

Tato práce se zabývá analýzou deliktů proti náboženství, které byly řešeny Krajským soudem v Olomouci mezi lety 1918 až 1921. Jsou zde zkoumány paragrafy, které se zabývají tzv. rušením náboženství. Tyto paragrafy jsou obsaženy v trestním zákonu z roku 1852. Práce se věnuje také problematice náboženské a právní situace v daném období. Cílem práce je přiblížit zájemcům tuto problematiku a seznámit je s konkrétními trestnými činy. Mezi primární prameny náleží soudní spisy archivního fondu Krajského soudu v Olomouci. V úvodní kapitole práce popisuje náboženskou situaci od druhé poloviny 18. století a spolu s ní spojenou sekularizaci a boj o kostely. Druhá kapitola se zaměřuje na právní situaci a vývoj trestního práva do roku 1918 a od roku 1918. Třetí a poslední kapitola se věnuje praktické části. Zde jsou popsány trestní delikty proti náboženství, které byly v daném období řešeny před Krajským soudem v Olomouci.

Abstract:

This thesis pursues the analysis of offences against religion which were solved by the Regional Court in Olomouc between the years 1918 and 1921. Paragraphs concerning disturbance against religion are examined. These paragraphs are included in the criminal law from the year 1852. Furthermore, the thesis deals with issue of religious and legal situation in the given period of time. The aim of this work is to introduce this issue to those interested and to acquaint them with specific crimes. Among the primary sources are the court records of the archival fund of the Regional Court in Olomouc. In the introductory chapter, the thesis describes the religious situation since the second half of the 18th century and the associated secularization and the co-called fight for churches. The second chapter focuses on the legal situation and the development of criminal law until 1918 and since 1918. The third and last chapter deals with the practical part. It describes criminal offences against religion, which were solved in the given period by the Regional Court in Olomouc.
