Municipal Generally Binding Ordinances

Abstract:

Obec je veřejnoprávní korporací s vlastním majetkem a vymezenými hranicemi území obce. Pečuje o rozvoj svého území, o potřeby svých občanů, plní své povinnosti a chrání veřejný zájem. Samostatné spravování vlastních záležitostí je umožněno vydáváním právních předpisů obce - obecně závaznými vyhláškami. Cílem diplomové práce je vymezit možnosti obce regulovat některé záležitosti místní samosprávy prostřednictvím tohoto právního předpisu. Práce přináší ucelený pohled na obecně závazné vyhlášky. Obsahuje úpravu právního předpisu v zákoně o obcích a také související judikaturu Ústavního soudu České republiky. V diplomové práci je popsán způsob přijímání, schvalování a publikace obecně závazných vyhlášek, včetně formálních a legislativně - technických náležitostí. Opomenuty zde nejsou ani kontrolní mechanismy a možnosti Ministerstva vnitra vykonávat dozor nad obecně závaznými vyhláškami. Uvedeny jsou i konkrétní příklady a osobní zkušenost z praxe starostky obce. Diplomová práce obsahuje rovněž názorné příklady nejčastěji vydávaných obecně závazných vyhlášek. Prostor je dán také aktuálním tendencím v judikatuře Ústavního soudu ČR k obecně závazným vyhláškám obcí.

Abstract:

A municipality is a public-law corporation with its own property and defined boundaries of the municipality's territory. It takes care of the development of its territory, the needs of its citizens, fulfils its obligations and protects the public interest. Issuing of municipal legislation - generally binding decrees - enables the independent management of its own affairs. The aim of the thesis is to define the possibilities of the municipality to regulate some local government matters through this type of legislation. The thesis provides a comprehensive view of general binding decrees. It includes the adaptation of the legislation in the Municipalities Act and also the related case law of the Constitutional Court of the Czech Republic. The thesis describes the method of adoption, approval and publication of generally binding decrees, including formal and legislative-technical requirements. The thesis do not leave out the control mechanisms and possibilities of the Ministry of the Interior to supervise generally binding decrees. Specific examples and personal experience from the practice of a municipal mayor are also provided. The thesis also contains illustrative examples of the most frequently issued general binding decrees. The current trends in the case law of the Constitutional Court of the Czech Republic on generally binding municipal ordinances are also mentioned.
