Law Against Unfair Competition and Industrial Property Law - Relation of Regulation

Abstract:

Jak už sám název napovídá, cílem diplomové práce je přiblížit vzájemný vztah právní úpravy nekalé soutěže a průmyslových práv. Vzhledem k jejímu omezenému rozsahu je hned v úvodu vybráno ze značně rozsáhlé problematiky práv průmyslového vlastnictví pouze známkové právo, na kterém je dále vztah obou právních úprav podrobně demonstrován. Úvodní kapitoly jsou věnovány zařazení ochranné známky v systému práva, vymezení jejích esenciálních znaků a v neposlední řadě také funkcím, které ochranná známka zejména v hospodářské praxi plní. Na tyto kapitoly navazuje problematika veřejnoprávní ochrany známky a s ní související překážky zápisné způsobilosti. Podrobněji je pak pozornost zaměřena na ty z překážek, které mají zvlášť úzký vztah k soutěžní funkci ochranné známky. Těžiště celé práce však spočívá až ve dvou závěrečných kapitolách. První z nich se soustředí na právní úpravu nekalé soutěže a objasnění vzájemného vztahu soutěžního a známkového práva. Druhá a zároveň také kapitola poslední završuje celý výklad rozborem právních prostředků a možností ochrany proti porušování práv z ochranné známky.

Abstract:

As the title of the diploma thesis suggests, its aim is to describe the mutual relation between the Czech legislative norms regulating unfair competition on the one hand and industrial property rights on the other. Due to the scope limitations of the thesis, the vast field of industrial property rights is narrowed down at the outset to trademark law on which the relation of the two legal norms is illustrated in detail. Introductory chapters deal with the categorization of a trademark within the system of law, provide definitions of its essential characteristics and focus also on the functions fulfilled by a trademark in economic practice. Further chapters focus on the topic of public law protection provided to a trademark and relating obstacles of eligibility for registration. A closer attention is paid to those obstacles that have an especially close relation to the competition function of a trademark. The center of the entire thesis, however, lies in the two final chapters. The first one focuses on the legal provisions regulating unfair competition and clarifies the relation between competition law and trademark law. The second one, that last chapter of the thesis, supplements the foregoing theoretical part with an analysis of the legal means and possibilities of protection against violation of trademark-related rights.
