Unjust enrichment in context of contract for work

Abstract:

Předkládaná rigorózní práce si klade za cíl analyzovat vybraná specifika bezdůvodného obohacení v oblasti aplikace smlouvy o dílo v české soukromoprávní úpravě. Autorka se nejdříve zabývá výší vydání bezdůvodného obohacení na základě neplatné smlouvy o dílo, kde analyzuje obecná východiska pro stanovení rozsahu obohacení, které vzniklo ze smlouvy o dílo. Dále je v práci podrobně analyzována problematika zhodnoce-ní majetku na základě plnění ze smlouvy o dílo ve vazbě na bezdů-vodné obohacení. Ve třetí kapitole se autorka zaobírá problemati-kou vypořádání bezdůvodného obohacení na základě plnění ze smlouvy o dílo uzavřené osobou s omezenou svéprávností a pro-blematikou postupného promlčování práva na vydání bezdůvodné-ho obohacení coby specifickou otázkou vzniknuvší ze smlouvy o dílo. Ve čtvrté kapitole je podrobně analyzována problematika ví-ceprací, kdy autorka nejdříve představí předchozí právní úpravy a následně analyzuje jednání nad rámec sjednaného závazku z pohledu současné právní úpravy. V poslední páté kapitole se au-torka zaobírá specifickými otázkami vypořádání bezdůvodného obohacení ze smlouvy o dílo s nehmotným výsledkem a při stano-vení konkrétního způsobu předání díla. Práce předkládá soudobý náhled a řešení na danou problema-tiku a současně předkládá návrhy de lege ferenda na právní úpravu smlouvy o dílo v kontextu bezdůvodného obohacení. V rozsahu ce-lé práce je kladen důraz na zahraniční komparace, dle které se au-torka v mnoha ohledech inspiruje.

Abstract:

Submitted rigorous thesis aims to analyse the selected specifics of unjustified enrichment in the field of application of the contract for work in Czech private law. The author first deals with the amount of unjustified enrichment based on an invalid work contract, analysing the general grounds for determining the extent of enrichment arising from a contract for work. Next, the thesis analyses in detail the issue of the appreciation of the asset on the basis of the performance under a contract for work in relation to unjustified enrichment. In the third chapter, the author deals with the issue of settlement of unjust enrichment based on the performance of a contract for work concluded by a person with limited legal capacity and the issue of gradual limitation of the right to unjust enrichment as a specific issue arising from a contract for work. The fourth chapter analyses in detail the issue of additional work, where the author first introduces the previous legislation and then analyses the conduct beyond the agreed obligation from the perspective of the current legislation. In the fifth and final chapter, the author deals with specific issues of unjust enrichment under a contract for work with an intangible result and in determining the specific manner of delivery of the work. The thesis presents a contemporary scope and solutions of the issue and at the same time makes de lege ferenda proposals for the legal regulation of a contract for work in the context of unjust en-richment. Throughout the scope of the work, emphasis is placed on foreign comparisons, which the author is inspired by in many re-spects.
