The Concept of Human Rights and the Persons with Disabilities

Abstract:

Cílem diplomové práce je odpovědět na otázku, zda současný koncept lidských práv také dostatečně chrání základní práva osob se zdravotním postižením. Práce se skládá ze třech částí. První část bude věnována vymezení základních pojmů, přičemž důraz bude kladen na vymezení práva na život ve světle historických koncepcí. Obsahem druhé částí bude rozbor platných pramenů práva obsahujících základní práva, a to jak mezinárodních smluv s univerzální působností, tak právních předpisů přijatých na půdě Evropy. Zvláštní důraz bude věnován právní úpravě České republiky. Třetí část bude tvořit rozbor aktuálních případů, na kterých budou demonstrovány poznatky získané v předchozích částech, tj. aplikace zjištěných nedostatků práva na konkrétní případy, kdy touto aplikací bude možné přinést odpověď na otázku, zda současný koncept lidských práv dostatečně chrání taktéž základní práva osob se zdravotním postižením.

Abstract:

The thesis aims to answer the question whether the current concept of human rights also adequately protects the fundamental rights of persons with disabilities. The work con-sists of three parts. The first part will be devoted to basic concepts, with particular em-phasis on the definition of the right to life in the light of historical concepts. The second part contains an analysis of the current valid sources of law comprising the basic law, both international treaties with universal jurisdiction, and the legislation adopted on the soil of Europe. Special emphasis will be devoted to the legislation of the Czech Repub-lic. The third part will consist of an analysis of actual cases, which will be demonstrated knowledge gained in the previous sections, ie. Applications identified shortcomings law to specific cases where this application will be possible to bring an answer to the questi-on whether the current concept of people-ber rights adequately protects also the funda-mental rights persons with disabilities.
