Marital property and carrying out the distraint of the property of one of the spouses

Abstract:

Bakalářská práce se zabývá společným jměním manželů a výkonem exekuce na majetek jednoho nebo obou manželů. Cílem práce je uvést, na jaký majetek je možné uvalit exekuční titul, a upozornit na možné negativní důsledky výkonu exekuce/rozhodnutí. Poskytnout srozumitelný návod, kdy a jakým způsobem se může manžel povinného, který neuzavřel závazkový vztah, při výkonu exekuce/rozhodnutí bránit, nebo mu úplně předejít. Součástí práce je zhodnocení aktuální platné úpravy majetkových vztahů mezi manželi a výkonu exekuce/rozhodnutí pomocí komparace České a Finské republiky. Praktická část obsahuje také kvantitativní výzkum pomocí dotazníkového šetření, jehož cílem je zjistit nedostatky v aktuální právní úpravě a objektivně zodpovědět stanovené výzkumné otázky. Na základě vyhodnocení všech dílčích výzkumných částí jsou v závěru práce navrženy změny v aktuální právní úpravě.

Abstract:

The bachelor thesis deals with the marital property and carrying out the distraint of the property of one or both spouses. The aim of the bachelor thesis is to state what property the enforceable title can be imposed on and to draw attention to the possible negative consequences of the enforcement of the distraint/decision. To provide clear guidance on when and how a spouse of a debtor, who has not entered a binding relationship, may defend himself during the distraint/decision, or to prevent them at all. Part of the bachelor thesis is the evaluation of current valid adjustment of property relations between husband and wife and execution of distraint/decision using comparison of Czech Republic and Finland. The practical part also contains quantitative research using the questionnaire survey to identify shortcomings in current legislation and to objectively respond to established research questions. Based on the evaluation of all the partial research parts, changes in the current legal regulation are proposed at the end of the thesis.
