Criminal liability of legal persons in the Czech Republic

Abstract:

Předložená bakalářská práce se zabývá trestní odpovědností právnických osob v České republice. Celá práce je členěna do 4 částí. V první části bakalářské práce jsou vymezeny základní pojmy – jde především o pojem právnická osoba, teorie právnických osob a také právní odpovědnost. Druhá část práce je věnována právní úpravě trestní odpovědnosti právnických osob ve vybraných zemích Evropské unie (např. jedná se o Slovensko, Francii a Německo). Další - třetí část bakalářské práce rozebírá problematiku trestní odpovědnosti právnických osob v České republice. V této části textu jsou charakterizovány jednotlivá ustanovení zákona č. 418/2011 Sb., o trestní odpovědnosti právnických osob a řízení proti nim. V rámci čtvrté části bakalářské práce jsou posouzeny výhody a nevýhody trestní odpovědnosti právnických osob a mimo jiné jsou uvedeny důvody pro a proti zavedení trestní odpovědnosti právnických osob. Hlavním cílem bakalářské práce je vymezení specifik právní úpravy trestní odpovědností právnických osob v rámci platné české úpravy zákona číslo 418/2011 Sb., o trestní odpovědnosti právnických osob a řízení proti nim. V textu bakalářské práce jsou využity metody deskripce, analýza, komparace a syntézy.

Abstract:

Abstract This bachelor thesis deals with criminal liability of legal entities in the Czech Republic. The whole work is divided into 4 parts. The first part of the bachelor's thesis defines the following basic terms: juridical person, the theory of juridical person and legal responsibility. The second part is devoted to legal regulation of criminal liability of legal entities in selected countries of the European Union (e.g. Slovakia, France and Germany). The third part of the bachelor thesis deals with the issue of criminal liability of legal entities in the Czech Republic. In this part of the text are described the individual provisions of Act No. 418/2011 Coll., regarding criminal liability of juridical persons and the proceedings against them. The fourth part of the bachelor thesis examines the advantages and disadvantages of the criminal liability of legal entities and, among other things, the reasons for and against the introduction of criminal liability of juridical persons. The main aim of the bachelor thesis is to define the specifics of the legal regulation of the criminal liability of legal entities in the framework of the Czech legislation No. 418/2011 Coll., regarding criminal liability of juridical persons and proceedings against them. The methods of description, analysis, comparison and synthesis are used in the bachelor thesis.
