Abstract:

Disertační práce se zabývá koncepcemi a principy existence a fungování majetkové podstaty v českém a zahraničním kontextu. Přináší teoretické rozpracování právní povahy majetkové podstaty a výklad tohoto základního institutu insolvenčního práva. Zabývá se rovněž rozsahem a obsahem majetkové podstaty, vč. majetku do podstaty zahrnutého nebo z ní vyloučeného. Samostatné pojednání pak představuje rozbor neúčinnosti právních jednání a vymezení majetkové podstaty v jednotlivých způsobech řešení úpadku. Výsledky práce jsou podrobeny srovnání se zahraniční právní úpravou, zejména s rakouskou a německou. Práce je zaměřena na samotnou existenci majetkové podstaty a v této souvislosti i na vymezení dispozičních oprávnění k majetkové podstatě. Zároveň je zde kladen důraz na procesní aspekty, vč. úvahy, zda by majetková podstata měla býti spíše předmětem insolvenčního práva nebo jeho objektem.

Abstract:

This Dissertation deals with the concepts and principles of existence and operation of the Assets in Bankruptcy in the Czech and international context. It provides the theoretical research of the legal nature of the Assets in Bankruptcy and the interpretation of this fundamental institution of the Insolvency Law. It also discusses the scope and content of the Assets in Bankruptcy including both property included and property excluded from it. The separate treatise then presents the analysis of Ineffectiveness of Legal Acts and the definition of the Assets in Bankruptcy concerning the various ways of dealing with Bankruptcy. The results of this work are subjected to the comparison with foreign legislation, with the Austrian and German especially. The Dissertation is focused on the very existence of the Assets in Bankruptcy and in this context it also focuses on the determination of the Right of Disposal to them. Concurrently an emphasis on the procedural aspects including considerations whether the Assets in Bankruptcy should rather be the subject of the Insolvency Law or the object of it is presented in this Dissertation.
