Major differences in regulatory impact assessment in the Czech Republic and in the United States of America in the years 2010–2020

Abstract:

Hodnocení dopadů regulace (RIA) je v současnosti velmi rozšířenou praktikou ve vyspělých zemích. Hlavním cílem hodnocení dopadů je zlepšit kvalitu regulací. Pro dosažení tohoto cíle slouží identifikace nákladů a přínosů u regulace, jež má zajistit lepší informovanost, jak pro regulátory, tak pro veřejnost. Hodnocení dopadů regulace ovšem není ve všech zemích stejné a liší se obsahem i šíří hodnocených regulací. Jedním z důvodů odlišnosti jsou zkušenosti při sestavování hodnocení dopadů získané s časem. Proto je v práci provedeno porovnání obsahu americké a české RIA, kde Spojené státy představují zemi s více zkušenostmi. Ze srovnání vyplývá, že americká RIA dokáže mnohem lépe kvantifikovat náklady i přínosy a celkově provádí komplexnější odhady dopadů. Oproti tomu české hodnocení dopadů lépe identifikuje problém a je aplikováno na více druhů návrhů regulace. Výsledkem celé práce je identifikování zásadních odlišností mezi českým a americkým způsobem sestavování RIA, kde rozdíly jsou hlavně ve způsobu analýzy dopadů a ve výběru variant hodnocených regulací.

Abstract:

Regulatory Impact Assessment (RIA) is currently a widespread practice in developed countries. The main goal of impact assessment is to improve the quality of regulations. The identification of costs and benefits serves to achieve this goal by ensuring that both the regulator and the public are well-informed. However, the regulatory impact assessment is not the same in all countries and it differs in the content and the scope of evaluated regulations. One of the many reasons for the difference is the experience gained by compiling impact assessments over long periods of time. Therefore, the thesis compares content of American and Czech RIA, where the United States presents country with more experience. Based on the comparison, American RIA is able to quantify costs and benefits much better and is generally more complex in evaluating the impacts. In contrast, Czech impact assessment identifies the problem better and is applied to more types of regulatory proposals. The result of the whole thesis is the identification of fundamental differences between Czech and American method of compiling RIA, where the differences are mainly in the method of impact analysis and in the selection of variants of evaluated regulations.
