The European anti-discrimination law

Abstract:

V diplomové práci je zaměřena na relevantní pojmy v oblasti antidiskriminačního práva (přímá a nepřímá diskriminace, rovnost, pozitivní opatření) s přihlédnutím k vnímání antidiskriminačního práva veřejností. Dále pak vývojem antidiskrkiminačního práva na úrovni Evropského práva, v systému Rady Evropy a v České republice. Třetí kapitola se zaměřuje na důležité instrumenty jež vznikly v rámci judikatury evropských soudů. V poslední části práce se věnuji vybraným soudním rozhodnutím v otázce asistované sebevraždy, diskriminaci z důvodu tělesného postižení a rasy.

Abstract:

At the first chapterof my thesis on a topic "Antidiscrimination european law" is focused on the relevant concepts of this topic. I described concepts like equality and her types, direct and indirect discrimination and also pozitive actions. Together with these concepts I try to describe my opinion on perception by the general publlic at the critical way. Second chapter is focused on development of the antidiscrimination law in European union, Council of Europe and also in the Czech republic. Because of too much materials for that part of topis, I chose the essential parts to describe and at least provide not very deep picture of developmnet of that part of law. The third chapter is describing the influence of decisions of courts to the practice focusing on most usual but used instuments thay had been developed by tce courts such as indirect discrimination, oportunity of using statistics, etc. The fourth and final chapter is focusing on significant european courts decisions in the are of health disability, assisted suicide and race.
